About the Office

The Office of the Public Trustee is a vital statutory office established under the Public Curator (Amendment) Act 2020 and derives authority from Section 26(k) of the Constitution under Division 2 of the Leadership Code. The Office is dedicated to providing professional and compassionate services in the administration of estates and trusts, ensuring the protection of assets and the welfare of beneficiaries.

Our Core Functions

The Office of the Public Trustee provides a range of essential services aimed at managing and protecting the assets and interests of individuals and estates:

  • Deceased Estate Administration: Managing the estates of deceased persons, including collecting assets, paying debts, and distributing the remaining assets to beneficiaries according to a will or intestacy laws.
  • Trustee Services: Acting as trustee for various types of trusts, including those for minors, individuals with disabilities, and charitable trusts.
  • Quasi-Judicial Services: Making decisions on certain estate matters where empowered by legislation, such as approving small estate distributions.
  • Legal Services for Estates: Providing legal advice and services related to wills, estate planning, and estate administration.
  • Management of Unclaimed Property: Holding and managing property where the rightful owner cannot be located, with efforts to reunite the property with its owner.
  • Protection of Minors and Incapacitated Persons: Acting to protect the financial interests of minors and individuals who are legally incapable of managing their own affairs.
  • Will-Making Services: Assisting individuals in the preparation of legally valid wills.
